Understanding Our CBA: Key Protections

Our contract is our strongest tool. Here are the “Big Three” articles every member should know by heart:

1. Weingarten Rights (Article 16.4)

If you are called into a meeting with management that you reasonably believe could lead to discipline, you have the right to stop the meeting and request a Union Representative. Statement to use: “If this discussion could in any way lead to my being disciplined or terminated, I respectfully request that my union representative be present.”

2. Progressive Discipline (Article 16.2)

Discipline must be corrective, not punitive. Except in cases of gross misconduct, management should follow these steps:

  1. Oral Warning
  2. Written Warning
  3. Suspension
  4. Discharge

3. The 15-Day Clock (Article 17.2)

Do not wait. You have only 15 calendar days from the date an incident occurred (or when you first learned of it) to file a formal grievance. If you miss this window, you may lose your right to challenge the action.
